{"id":2511,"date":"2021-10-21T11:18:13","date_gmt":"2021-10-21T15:18:13","guid":{"rendered":"https:\/\/firstandpen.com\/staging\/5861\/?p=2511"},"modified":"2021-10-21T17:07:30","modified_gmt":"2021-10-21T21:07:30","slug":"nfl-end-race-norming-testing-black-players","status":"publish","type":"post","link":"https:\/\/firstandpen.com\/staging\/5861\/nfl-end-race-norming-testing-black-players\/","title":{"rendered":"NFL Agrees To End Race Norming But What About Black Players They Denied?"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">Yesterday the NFL and lawyers for retired NFL players reached an agreement to end &#8220;race norming&#8221; in testing in the 2016 $1 billion settlement over concussion claims.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The agreement was filed Wednesday in federal court.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><a href=\"https:\/\/firstandpen.com\/staging\/5861\/?s=race+norming\" target=\"_blank\" rel=\"noreferrer noopener\">Race norming<\/a> assumes Black athletes start at a lower cognitive functioning level than white athletes. So in tests used by the NFL to determine cognitive impairment and\/or damage, Black players had a harder time showing any deficit from concussions. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That meant that Black players who were suffering from adverse health conditions due to concussions were prevented from financial awards, which averaged $500,000 or more, through the settlement for treatment. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It&#8217;s a practice that added to <a href=\"https:\/\/firstandpen.com\/staging\/5861\/black-players-race-norming-nfl-settlement\/\" target=\"_blank\" rel=\"noreferrer noopener\">Black pain felt by players and their families<\/a>.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In this new agreement, <a href=\"https:\/\/www.nytimes.com\/2021\/10\/20\/sports\/football\/nfl-concussion-settlement-race.html\">according to The New York Times<\/a>, Black retirees will have the opportunity to have their tests rescored or, in some cases, have a new round of cognitive testing done. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The proposal must be approved by a judge, but at least the two parties have agreed to remove the biased testing.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe look forward to the court\u2019s prompt approval of the agreement, which provides for a race-neutral evaluation process that will ensure diagnostic accuracy and fairness in the concussion settlement,\u201d said NFL lawyer Brad Karp in a statement.<\/p><div id=\"first-2186218152\" class=\"first-content first-entity-placement\"><!-- \/22950135888\/FAP_Article_Leaderboard_Instream2 -->\r\n<div id='div-gpt-ad-1700413625220-0' style='min-width: 300px; min-height: 90px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1700413625220-0'); });\r\n  <\/script>\r\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">The inclusion of race norming went unnoticed until 2018, two years after the 2016 landmark settlement was reached. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s when attorney Cyril V. Smith, who represented former players\u00a0<a href=\"https:\/\/tropicsofmeta.com\/2020\/11\/01\/race-ing-the-nfl-how-anti-black-standards-are-built-into-the-2015-concussion-settlement\/\">Kevin Henry and Najeh Davenport<\/a>, stepped in.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">In August of 2020, Smith filed a class-action lawsuit against the NFL on behalf of his clients who were not only suffering but whose claims were rejected after race normed tests. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The original tests for both Henry and Davenport showed serious cognitive impairment. The NFL denied the claim and made them take a second test, which was race normed, and that showed less damage. <\/p><div id=\"first-1446273892\" class=\"first-content_2 first-entity-placement\"><!-- \/22950135888\/FAP_Article_Leaderboard_Instream3 -->\r\n<div id='div-gpt-ad-1700413989195-0' style='min-width: 300px; min-height: 90px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1700413989195-0'); });\r\n  <\/script>\r\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">As a result, both of their claims were denied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This past March, the judge presiding over the case rejected the lawsuit and ordered them to resolve the issue through mediation.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two months later in May, former Washington running back Ken Jenkins, and his wife Amy Lewis delivered over signed 50,000 petitions to Senior U.S. District Judge Anita B. Brody in Philadelphia, who was overseeing the case. The petitions disparaged the discriminatory testing and demanded its end.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;My reaction was, \u2018Well, here we go again,\u2019\u201d said Jenkins at the time. \u201cIt\u2019s the same old nonsense for Black folks, to have to deal with some insidious, convoluted deals that are being made.\u201d<\/p><div id=\"first-825357892\" class=\"first-content_3 first-entity-placement\"><!-- \/22950135888\/FAP_Article_Leaderboard_Instream4 -->\r\n<div id='div-gpt-ad-1700414036595-0' style='min-width: 300px; min-height: 90px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1700414036595-0'); });\r\n  <\/script>\r\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">Jenkins couldn&#8217;t have put it any better.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">70% of active NFL players, and more than 60% of living league retirees, are Black, so it&#8217;s obvious to see how impactful and detrimental race norming could be to Black players.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">It&#8217;s a ridiculous burden suffering Black players should never have been forced to carry, one that exposed another layer of systematic racism in sports that many deny exists.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But it does.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c(Because) every Black retired NFL player has to perform lower on the test to qualify for an award than every white player. And that\u2019s essentially systematic racism in determining these payouts,\u201d\u00a0<a href=\"https:\/\/www.marketwatch.com\/story\/retired-black-nfl-players-and-their-families-call-for-race-norming-practice-to-end-01621018741\">said Katherine Possin<\/a>, a neurology professor at the UCSF Memory and Aging Center.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">These payouts have totaled $821 million to date, and cover five types of brain disease including, Parkinson&#8217;s, all forms of dementia and Lou Gehrig&#8217;s disease, also known as ALS.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the demographic allocation of the payouts is unclear, lawyers for the Black players feel that white players were awarded payouts anywhere from two to three times the rate for Black players.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">After the recent <a href=\"https:\/\/firstandpen.com\/staging\/5861\/jon-gruden-showed-us-that-where-theres-smoke-theres-an-inferno\/\" target=\"_blank\" rel=\"noreferrer noopener\">Jon Gruden email scandal<\/a> and the NFL&#8217;s statement that &#8220;no other current personnel&#8221; have sent emails like the ones Jon Gruden did, it&#8217;s not hard for everyone to echo those sentiments. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That&#8217;s why Jenkins has asked the Civil Rights Division of the Justice Department to investigate. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;If the new process eliminates race-norming and more people qualify, that\u2019s great,\u201d said Jenkins, who does not have an impairment but advocates for those who do.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201c(But) we\u2019re not going to get everything we wanted,\u201d Jenkins, an insurance executive, said Tuesday. \u201cWe want full transparency of all the demographic information from the NFL \u2014 who\u2019s applied, who\u2019s been paid.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Under the new agreement, which states that the new testing formula was developed in conjunction with a panel of experts, the mandate is clear.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cNo race norms or race demographic estimates \u2014 whether Black or white \u2014 shall be used in the settlement program going forward,\u201d the proposal said.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">But for those who have been in pain while waiting, it&#8217;s now a new time of waiting where they must again hope that they get approved to receive the treatment they need and deserve. <\/p>\n","protected":false},"excerpt":{"rendered":"<p>Yesterday the NFL and lawyers for retired NFL players reached an agreement to end &#8220;race norming&#8221; in testing in the 2016 $1 billion settlement over concussion claims.
