{"id":2114,"date":"2021-07-29T08:48:58","date_gmt":"2021-07-29T12:48:58","guid":{"rendered":"https:\/\/firstandpen.com\/staging\/5861\/?p=2114"},"modified":"2021-07-29T08:50:13","modified_gmt":"2021-07-29T12:50:13","slug":"appeals-court-backpedals-from-race-norming-controversy-in-nfl-concussion-settlement","status":"publish","type":"post","link":"https:\/\/firstandpen.com\/staging\/5861\/appeals-court-backpedals-from-race-norming-controversy-in-nfl-concussion-settlement\/","title":{"rendered":"Appeals Court Backpedals From Race Norming Controversy In NFL Concussion Settlement"},"content":{"rendered":"\n<p class=\"wp-block-paragraph\">This week, a federal appeals court backpedaled away from <a href=\"https:\/\/firstandpen.com\/staging\/5861\/?s=race+norming\" target=\"_blank\" rel=\"noreferrer noopener\">the race norming controversy<\/a> that flared up in the NFL&#8217;s concussion settlement.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their decision made a frustrating situation even more infuriating for former Black players and their families who are struggling to receive financial awards to help their suffering.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe District Court dismissed the motion without prejudice and its order indicates that it is not the final word on the subject of \u2018race norming,&#8217;\u201d <a href=\"https:\/\/theathletic.com\/2734606\/2021\/07\/28\/appeals-court-declines-to-take-on-nfl-concussion-settlements-race-norming\/\">wrote the three judges<\/a>. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Those judges, Thomas Ambro, Patty Shwartz, and David Porter, decided to let the situation play out instead of wading into the controversy. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This all started back in 2016 when the Supreme Court refused to hear an appeal of a lower court&#8217;s ruling in a settlement case. That decision enabled the NFL&#8217;s $1 billion settlement over concussion-related lawsuits with retired players to commence<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Two years later, the discriminatory practice of race norming in the settlement was brought to light. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Race norming assumes that Black athletes start with lower cognitive functioning than white athletes. So when Black athletes are tested to see if they suffered from concussions, it&#8217;s harder for them to show a deficit as they start off at a lower point.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">That, in turn, prevents Black players from qualifying for financial compensation from the settlement for treatment.<\/p><div id=\"first-3659294460\" class=\"first-content first-entity-placement\"><!-- \/22950135888\/FAP_Article_Leaderboard_Instream2 -->\r\n<div id='div-gpt-ad-1700413625220-0' style='min-width: 300px; min-height: 90px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1700413625220-0'); });\r\n  <\/script>\r\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">This practice <a href=\"https:\/\/firstandpen.com\/staging\/5861\/black-players-race-norming-nfl-settlement\/\" target=\"_blank\" rel=\"noreferrer noopener\">negatively impacted Black players<\/a> such as Kevin Henry and Najeh Davenport. Their initial test results showed serious cognitive impairment. Their second tests, which were race normed, showed a smaller cognitive loss. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">As a result, their claims were denied.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Their attorney, <a href=\"https:\/\/www.classaction.org\/media\/henry-et-al-v-national-football-league-et-al.pdf\">Cyril V. Smith<\/a>, challenged the test and practice in 2020. This past March, federal judge Anita Brody dismissed their motions. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While she expressed concern over the practice, she ultimately ordered them to settle it through mediation. <\/p><div id=\"first-3856998540\" class=\"first-content_2 first-entity-placement\"><!-- \/22950135888\/FAP_Article_Leaderboard_Instream3 -->\r\n<div id='div-gpt-ad-1700413989195-0' style='min-width: 300px; min-height: 90px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1700413989195-0'); });\r\n  <\/script>\r\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cWe are deeply concerned that the Court\u2019s proposed solution is to order the very parties who created this discriminatory system to negotiate a fix,\u201d&nbsp;<a href=\"https:\/\/apnews.com\/article\/judge-tosses-race-norming-suit-nfl-dementia-tests-ed61e9917fcd94d79c1fe79a13e037e0\">said Smith in March<\/a>. \u201cThe class of Black former players whom we represent must have a seat at the table and a transparent process.\u201d<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Four months after her decision, the Appeals Court sided with Judge Brody.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">According to The Athletic, a status report on the mediation was due two weeks ago, but the magistrate judge overseeing the negotiations issued a gag order for all parties on July 16th.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Back in June, the NFL and Christopher Seeger, the lead lawyer for more than 20,000 retirees covered by the settlement, <a href=\"https:\/\/firstandpen.com\/staging\/5861\/nfl-pledges-to-end-race-norming-tests-that-devalued-pain-of-black-players\/\" target=\"_blank\" rel=\"noreferrer noopener\">agreed to end the use of race norming in the testing<\/a>.<\/p><div id=\"first-3962696539\" class=\"first-content_3 first-entity-placement\"><!-- \/22950135888\/FAP_Article_Leaderboard_Instream4 -->\r\n<div id='div-gpt-ad-1700414036595-0' style='min-width: 300px; min-height: 90px;'>\r\n  <script>\r\n    googletag.cmd.push(function() { googletag.display('div-gpt-ad-1700414036595-0'); });\r\n  <\/script>\r\n<\/div><\/div>\n\n\n\n<p class=\"wp-block-paragraph\">\u201cThe replacement norms will be applied prospectively and retrospectively for those players who otherwise would have qualified for an award but for the application of race-based norms,\u201d said NFL spokesman Brian McCarthy.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Yet despite their decision, questions still remain.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Will Black players who have been tested already, like Henry and Davenport, have to be retested and rescored? And how many Black players were negatively impacted by race normed tests?<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">While the NFL has not released that number, it&#8217;s obvious that there are numbers. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And those Black players are suffering.<\/p>\n","protected":false},"excerpt":{"rendered":"<p>This week, a federal appeals court backpedaled away from the race norming controversy that flared up in the NFL&#8217;s concussion settlement.
